The complaints of disgruntled presidential candidates protesting the results of the 2023 presidential election are now being heard by the Presidential Election Complaints Tribunal.
In the meantime, INEC, Tinubu, Shettima Kashim, and the APC are listed as respondents in Obi's petition, which was filed jointly by him and his party.
Let's look at Obi's five courtroom prayers:
Election Cancellation
Obi and his party are attempting to have the presidential election of February 25 annulled.
According to the, “The Presidential election conducted on 25th February 2023 is void on the ground that the election was not conducted substantially by the provisions of the Electoral Act 2022 and Constitution of the Federal Republic of Nigeria 1999, as amended.”
25% in FCT
Concerning 25% in the Federal Capital Territory (FCT), the second prayer is offered. This has sparked more controversy since INEC has stated that Tinubu did not need 25% of the vote in the federal capital territory to be declared the winner because he had received more than 25% of the vote in many states and a majority in others.
Fresh Elections
The Labour Party and its presidential candidate also requested the court to order INEC to hold new elections in addition to cancelling the previous ones.
Eligibility
Obi’s lead lawyer, Livy Uzoukwu in his submission, said the president-elect “was not duly elected by a majority of the lawful votes cast at the time of the election.”
The APC candidate, according to Obi, "was linked to drug trafficking by US court" and ultimately forfeited $460,000 to the US government, adding that he is "not qualified to contest Nigerian presidency."
Disqualify Tinubu and Shettima from running in the next elections
The candidate for the Labour Party claimed that Tinubu and his deputy should both be disqualified from the new elections since they are purportedly ineligible.
Obi and his party in the petition said “The nomination of Kashim Shettima as a vice presidential candidate was defective as he did not withdraw from his nomination as a senatorial candidate of his party before accepting to serve as the vice presidential candidate of Mr Tinubu”
