In Suit N0 HOK/51/2019 filed by Oloja Juwon Semudara who is a legal practitioner, the Claimant sued Benjamin Olomidegun a businessman over dredging works in the area, claiming that the piece of land at Kofawe was sold to him by the Apoi people while the latter was in court with the Igbokoda/Mahin/Ilaje community over the ownership of the land.

He further claimed that the land he surveyed was later granted to him by agreement with the Igbokoda/Mahin/ community on January 19, 1995, by the Attorneys of a community who won their case in court, bringing home a verdict that confirmed his appointment as head ("oloja") of Kofawe.

However, the Olu (Oba) of Igbokoda, through his counsel and chief Sola Ebiseni, applied to join with a counter-claim insisting that Kofawe Kurugbene and Ipinle are all parts of Igbokoda land as decided by the Colonial Provincial Court in 1917 in a suit between the Amapetu of Mahin representing the Igbokoda community and the Kalasuwe Oba of the Ijaws.

He further declared that Juwon Semudara had no land in any part of Igbokoda, which includes Kofawe, Kurugbene and Ipinle and all separate communities.

The defendants argued that the Agreement and Survey Plan of Juwon Semudara was not genuine, and even if it were, there would be no way for land purportedly granted at Kurugbene to convey anything more than what already existed in Kofawe

In addition to the two claims relating to land at Kofawe mentioned above, three other cases in which the same Claimant was involved were consolidated.

The court’s nineteen-page judgment, delivered by Justice Temitope M. Adedipe, found that all parties agreed Kurugbene and Kofawe are separate communities—and the claimant and his witnesses confirmed as much under oath which the Claimant and his witnesses confirmed in evidence.
