

On Thursday, the Supreme Court adjourned an appeal brought by Senator Smart Adeyemi regarding the Kogi APC Governorship primary election until October 23, 2023.
Usman Ododo was chosen by the All Progressive Congress to represent the party in the November 11 governorship election in the state. Adeyemi had filed a lawsuit at the Federal High Court to have the election declared null.
Both the High Court and the Court of Appeal dismissed the case for lack of merit.
When hearing his appeal on Thursday, the supreme court informed his attorney, Musibau Adetumbi, SAN, that his client was contesting concurrent findings from the High Court and the Court of Appeal that primary elections had taken place in Kogi State, but that he had neglected to raise objections to these concurrent findings.
However, the appellant's attorney declared that he would proceed with the appeal.
As a result, the Supreme Court adjourned ruling on the appeal until October 23, 2023.
Chief Anthony Adeniyi (SAN), Abdulwahab Mohammed (SAN), and M.Y. Abdullahi, SAN, respectively, are the representatives of the Independent National Electoral Commission, the All Progressives Congress, and Usman Ododo.
On August 18, 2023, the Court of Appeal declared that Adekunle Otitoju's appeal on behalf of Adeyemi was utterly without merit.
Adeyemi was found to have fallen short of proving all the criminal charges made against the APC and its officials about the handling of the primary election, according to a unanimous decision by a three-judge panel of the Court.
